Introduction

By downloading, installing, registering with, accessing, or using the Cleana application (Cleana), these terms and conditions (Terms and Conditions) will automatically apply to you – you should make sure therefore that you read them carefully before using Cleana.

Cleana provides services to detect and delete duplicate and similar photos, videos, and other media files in order to free up storage on your iOS and Android devices (Services).

Consumer Rights and Protection

Consumer Rights in Turkey

If you are a consumer in Turkey, you have certain rights under the Consumer Protection Law No. 6502 (the “Law No. 6502”). These rights include but are not limited to:

Right to Withdraw: As per Article 49 of the Law No. 6502, consumers have the right to withdraw from distance contracts without giving any reason within 14 days from the date of delivery of the goods or conclusion of the service contract. However, you acknowledge and agree that digital content and services that are delivered electronically may not be subject to the right of withdrawal if the performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal.
Defective Services: As per the Law No. 6502, if the service is defective, you have the right to:
- Request repair of the defect
- Request a replacement service
- Request a price reduction
- Terminate the contract and request a refund
These rights can be exercised within two years from the delivery of the defective service.
Dispute Resolution: In accordance with the Law No. 6502, for disputes related to consumer transactions:
- For transactions below the threshold amount set by the Ministry of Trade annually, Consumer Arbitration Committees have jurisdiction
- For transactions above the threshold amount, Consumer Courts have jurisdiction
Digital Services: For digital service agreements, Xeplin Apps complies with the provisions of the Law No. 6502 and relevant regulations regarding digital service contracts.

Turkish Law Compliance

Xeplin Apps operates in compliance with Turkish laws, including but not limited to:

The Consumer Protection Law No. 6502
The Law on Intellectual and Artistic Works No. 5846
The Law on the Protection of Personal Data No. 6698
Electronic Commerce Law No. 6563

If you are a consumer in Turkey, the mandatory provisions of Turkish consumer protection laws shall apply regardless of any choice of law provision in these Terms and Conditions.

Distance Selling Disclosure

In accordance with the Distance Contracts Regulation issued under the Law No. 6502, Xeplin Apps provides the following information:

Identity and contact details of Xeplin Apps as provided above
Essential characteristics of Cleana as described in the App description
Total price including all taxes and fees
Payment, delivery, and performance conditions
Right of withdrawal information
Technical requirements for using Cleana
Duration of the contract and conditions for termination

Rights and Restrictions

This Terms and Conditions only grants you the right to use Cleana to benefit from Services within the scope defined herein. You’re not allowed to copy or modify Cleana, any part of Cleana, or our trademarks in any way. For detailed intellectual property information, please see the “Intellectual Property Rights” section below.

Age Restriction and Eligibility

The Service is intended for users who are at least 16 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 16) must have the permission of, and be directly supervised by, their parent or guardian to use the Service. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Service.

By using Cleana, you represent and warrant that:

You have the legal capacity to agree to these Terms;
You are at least 16 years of age, or have obtained parental consent if you are under 16;
You will not use the Service for any illegal or unauthorized purpose;
Your use of the Service will not violate any applicable law or regulation.

Data Security and Responsibility

Xeplin Apps stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to Cleana secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features, and it could mean that Cleana won’t work properly or at all.

You should be aware that there are certain things that Xeplin Apps will not take responsibility for. Certain functions of Cleana will require Cleana to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Xeplin Apps cannot take responsibility for Cleana not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

Subscriptions and Billing

Free Trials and Subscriptions

Certain premium features of Cleana may be accessible through in-app purchases and subscriptions. By purchasing a subscription, you agree to the following terms:

Free Trials: Where offered, free trials will automatically convert to paid subscriptions UNLESS CANCELED AT LEAST 24 HOURS BEFORE THE END OF THE TRIAL PERIOD. The price for the subscription will be clearly displayed on the payment screen before purchase.
Automatic Renewal: All subscriptions will automatically renew at the end of the applicable subscription period (weekly, monthly, annually, or as otherwise indicated) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Payment Processing: Payments will be charged to your App Store account at confirmation of purchase or after the end of the free trial period (if applicable).
Subscription Management: You can manage and cancel your subscriptions through your App Store account settings. Please note that deleting the app does not cancel your subscription.
Refunds: Subscriptions purchased via App Store are subject to App Store refund policies. Xeplin Apps cannot process refunds directly for in-app purchases. To request a refund, please contact App Store support.
Price Changes: We reserve the right to change subscription prices. Any price changes will apply only to subsequent subscription periods and will be communicated in advance.

Use of App and Charges

If you’re using Cleana outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing Cleana, or other third-party charges. In using Cleana, you’re accepting responsibility for any such charges, including roaming data charges if you use Cleana outside of your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using Cleana, please be aware that we assume that you have received permission from the bill payer for using Cleana.

Along the same lines, Xeplin Apps cannot always take responsibility for the way you use Cleana i.e., you need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Xeplin Apps Service, Xeplin Apps cannot accept responsibility.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Use the Service in any manner that could disable, overburden, damage, or impair the Service;
Use any robot, spider, crawler, scraper, or other automated means to access the Service;
Attempt to bypass any measures designed to prevent or restrict access to the Service;
Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material;
Copy, modify, create derivative works from, distribute, or publicly display any content from the Service without prior written consent;
Attempt to decompile, reverse engineer, disassemble, or hack the Service;
Use the Service in a way that infringes upon the rights of others, or in any way violates these Terms and Conditions;
Use the Service for any illegal purpose, or to violate any local, state, national, or international law;
Impersonate or misrepresent your affiliation with any person or entity;
Attempt to collect or store personal data about other users without their consent.

We reserve the right to terminate your use of the Service or suspend your account for violations of these prohibited activities.

Third-Party Information

With respect to Xeplin Apps’s responsibility for your use of Cleana, when you’re using Cleana, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Xeplin Apps accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of Cleana.

Updates and Termination

At some point, we may wish to update Cleana. Cleana is currently available on iOS and Android – the requirements for the system (and for any additional systems we decide to extend the availability of the app to) may change, and you will need to download the updates if you want to keep using Cleana. Xeplin Apps does not promise that it will always update Cleana so that it is relevant to you and/or works with the operating system version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing Cleana, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using Cleana, and (if needed) delete it from your device.

Disclaimer for Professional Advice

While using Cleana, please be aware that the services provided by Cleana cannot be deemed professional healthcare and/or mental health services, therefore shall not be considered as medical and/or professional advice. Xeplin Apps shall not be responsible for any of the information, data, communication provided as an Output through Cleana.

User Content

You may provide, upload, transmit, create, store, use, edit, or share contents such as text, information, questions, documents, images, or other materials with or through the Services (Input) and receive output from these interactions (Output). By using the Services, you grant Xeplin Apps a non-exclusive, irrevocable license to use the User Content for the purposes of operating and improving our Services.

Intellectual Property Rights

Xeplin Apps is the sole proprietor of products, services, visuals, texts, designs, know-how, illustrations, database, logo, emblem, code, and all other intellectual property rights used in connection with Cleana. All rights that are vested under relevant intellectual property laws shall be the exclusive property of Xeplin Apps.

You may not delete, alter, or remove any copyright, trademark, or other proprietary notices Xeplin Apps or third-party partners have placed on or within Cleana. You agree not to reverse engineer or attempt to find or acquire the source code of Cleana, nor shall you violate the security of any network or crack security encryption codes.

Unless otherwise agreed between Xeplin Apps and you regarding any intellectual property rights arising from any service provided to you, Xeplin Apps shall grant you the right to use the related services which shall be worldwide, non-exclusive, and limited to the purposes set forth in these Terms and Conditions.

You are solely responsible for any content that you contribute, submit, or display through Cleana. It is your obligation to ensure such content, including photos, texts, documents, videos, and music files, does not violate any copyright or other intellectual property rights.

Warranty Disclaimer

TO THE EXTENT PERMITTED BY APPLICABLE LAW, CLEANA IS PROVIDED ON AN “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE” BASIS, AND YOU USE IT AT YOUR SOLE RISK. XEPLIN APPS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITATION, XEPLIN APPS MAKES NO WARRANTY THAT CLEANA WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE RESULTS OBTAINED FROM THE USE OF CLEANA WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF CLEANA WILL MEET YOUR EXPECTATIONS.

XEPLIN APPS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF CLEANA; ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM CLEANA; ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED BY ANY THIRD PARTY; OR ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A CONSEQUENCE OF USING CLEANA.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XEPLIN APPS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (I) THE USE OR INABILITY TO USE CLEANA; (II) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (III) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR (IV) ANY OTHER MATTER RELATING TO CLEANA.

IN NO EVENT SHALL XEPLIN APPS’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU FOR ACCESSING CLEANA, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE CAUSE OF ACTION.

Indemnification

You agree to indemnify, defend, and hold harmless Xeplin Apps, its affiliates, officers, directors, licensors, partners, shareholders, contractors, agents, attorneys, employees, and third-party service providers from any claims, liabilities, costs, and expenses, including reasonable attorneys’ fees, that actually or allegedly result from your use of Cleana or your breach of these Terms and Conditions.

You agree to be solely responsible for defending any claim against or suffered by Xeplin Apps, subject to Xeplin Apps’ right to participate with counsel of its own choosing, and for payment of damages or losses resulting from all claims against Xeplin Apps, provided that you will not agree to any settlement that imposes any obligation or liability on Xeplin Apps without Xeplin Apps’ prior express written consent.

Dispute Resolution and Governing Law

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Most concerns can be resolved quickly by contacting us at [email protected]. In the event that we cannot resolve a dispute through informal channels, you agree to the following:

Jurisdiction

For any disputes arising out of or relating to these Terms and Conditions or Cleana, the Istanbul Courts and Execution Offices shall have exclusive jurisdiction.

Electronic Communications

By using Cleana, you consent to receive electronic communications from Xeplin Apps. These communications may include notices about your account, updates to Cleana, and promotional information, and are part of your relationship with Xeplin Apps.

You agree that any notices, agreements, disclosures, or other communications that Xeplin Apps sends to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Force Majeure

In all circumstances that constitute a force majeure event in legal terms, Xeplin Apps shall not be held liable for its failure to perform its obligations hereunder or to perform them late or incompletely. Such failures shall not be considered a default, or incomplete or faulty performance, and no claim of compensation shall be made against Xeplin Apps.

The term “force majeure events” herein refers to any event that is beyond the reasonable control of the affected party and that cannot be avoided despite the reasonable care and diligence shown by Xeplin Apps, including but not limited to acts of God, riots, insurgences, turmoil, war, communication interruptions, infrastructural and internet network failures, power failures, and adverse weather conditions.

Changes to Terms and Conditions

Xeplin Apps reserves the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new Terms and Conditions on this page and updating the “Last updated” date. Your continued use of Cleana following the posting of revised Terms and Conditions means that you accept and agree to the changes.

Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be deemed severed from these Terms and Conditions to the minimum extent necessary, and the remaining provisions shall be enforced to the fullest extent under law.

Complete Agreement

These Terms and Conditions constitute the entire agreement between you and Xeplin Apps regarding Cleana and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
